The rationale behind the Scoobies' non-stakage of Spike in S4 is that he's "harmless" with a chip. While he may want to do evil things, they don't think he can. Therefore, the threat is neutralized.

However, by the end of S4, he proved that he could still be a threat, though by working through Adam. But after the big fight, I think the Scoobies were too exhausted to follow up in any significant way (especially as Spike's efforts ultimately failed to split them up).

In OOMM, though, Spike becomes an immediate threat, one that nearly results in Riley dying. This is a far more serious incident than Spike merely talking about wanting to eat Xander. This is Spike actively using Harmony to kidnap a doctor to get his chip out (in the process, leaving Riley without treatment). That should be enough to justify staking him from any sort of moral standpoint.
